Your use of our Services is also subject to our Privacy Policy. Other services offered by Boatsetter may be subject to separate terms.
We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.
We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order.
Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.
2. Security
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. 3. Third Party Disclaimer
By the Client using this site and our services it is understood and agreed that YachtDudes LLC © make no representations, commitments, or warranties regarding the completion, functionality, or performance of any third party services that may be used. When Clients use the website content of YachtDudes, correspond with staff members, and purchase services from third parties then Client does so solely at their own risk.
YachtDudes shall have no liability or obligation whatsoever in relation to the satisfaction or completion of services agreed and rendered, or correspondence with, any such third-party vendor, or any transactions completed, and any contract entered between owners and renters. YachtDudes is not a party to any agreements entered into between owners and renters, nor is YachtDudes a boat/yacht broker, agent, or insurer. All users of this website understand YachtDudes have no control over the conduct of owners, renters, and other users of the site, and their services, and therefore disclaims all liability and responsibility in this regard.
4. Price Match Guarantee
To qualify for a price match quote, Client must have a printed verifiable offer that shows same type of booking for a yacht, boat, or vessel. Quote must be for the same marine vessel size as well as the same rental date and time. In addition, all price quotes must include all taxes and additional fees. This price match guarantee does not include prices obtained by the use of benefits (for example memberships) or promotional rates of any kind.
Under qualifying for a Price Match Guarantee, YachtDudes LLC © has granted and sold a limited-time (limited to the time paid for by Client), limited, not freely transferable, nonexclusive, revocable price match quote to Client hereunder. All rights and obligations of YachtDudes© under this agreement shall be performed by YachtDudes©, or its authorized agents, representatives, vendors, successors or assigns.
5. In a Yacht, Under 2 Hours® Clause
In contacting YachtDudes LLC ©, you are agreeing that our comments or claims about the time frame and outcome of any service (i.e. In a Yacht, Under 2 Hours®) are expressions of opinion only. It is understood that it is impossible to predict Client’s preferences or budget, availability of yachts, both client and vessel location, and any/all other variable that could delay or prevent a potential charter within any self-imposed time limit.
Upon request of a In a Yacht, Under 2 Hours® service, YachtDudes shall put forth every reasonable effort to satisfy the Client’s request within the target period, however the Client understands and agrees YachtDudes shall have no liability in relation to the outcome within or without the projected time frame.
6. Definitions
“Bareboat Rental” A rental of a Boat supported by a written agreement whereby the Boat Owner transfers “the incidents of ownership” including but not limited to full possession, control and use of the Boat to Renter and Renter is responsible for all aspects of the Boat during the Rental including manning, provisioning and otherwise.
“Boat(s)” means marine vessels.
“Renter” means a Member who requests a booking of a Boat via the Services, or a Member who uses a Boat and is not the Owner for such Boat.
“Owner” means a person who creates and manages a Listing via the Services, is responsible for approving rentals, checking in or out a Renter, or responding to messages on the website. The Owner does not have to be the boat, Boat Owner, but will need to be appointed and approved by the Boat Owner.
“Listing” means a Boat that is listed on our site for an Owner.
